Mental Capacity and Deprivation of Liberty: what does this mean for housing?
The Law Commission consultation on the proposed changes to Deprivation of Liberty Safeguards (DoLS) highlighted the housing and support sectors lack of clarity on Mental Capacity, when a deprivation of liberty may occur and current safeguards.
In response to this Sitra and Bevan Brittan are holding two half day workshops in Bristol and Birmingham to support providers understand the implications of Mental Capacity and Deprivation of Liberty when providing services to vulnerable people.
The briefing will cover
• How to assess Mental Capacity and the impact of proving services to people who may lack capacity
• What constitutes a Deprivation of Liberty and how to ensure that safeguards are complied with
• Recent case law on Mental Capacity and Deprivation of Liberty
