Written Statement of Particulars
Employers are under an obligation to provide employees with a written statement of particulars of their employment within 2 months of the start of their employment under S.1 of the Employment Rights Act 1996.
These particulars must include:
- The names of the employer and employee;*
- The date on which employment began, including any period of continuous employment;*
- Rates of pay or methods of calculating pay and frequency of payment;*
- Hours of work, including normal working hours;*
- Terms relating to holidays, including public holidays and holiday pay;*
- The employee?s job title or a brief description of the work for which s/he is employed;*
- Place of work, including details of any mobility clause, and the employer?s address;*
(*These need to be given in a single document.)
The statement may be given in instalments (apart from those above which are required to be given in a single document) or refer to other documents to which the employee has reasonable access.
The following can be given in instalments.
- Rules relating to sickness or injury and sick pay;
- Pension arrangements;
- The length of notice required by each party;
- Details of any work abroad lasting more than one month;
- If employment is not intended to be permanent, the period for which it is expected to continue, or if a fixed-term contract, it?s expiry date;
- Any collective agreements which directly affect the terms and conditions of employment
- The disciplinary procedure (where there are fewer than 20 employees at the date employment began the details need only relate to the person from whom the employee can seek redress).
